Welcome to Backyard Remedy, LLC. (“we”, “our”, “us”). These Terms and Conditions govern the use of our website, Flags-for-freedom.com, and the subscription services we offer (our “Services”). By accessing or using our Services, you agree to these Terms and Conditions.
1. Definitions
“Account” means customer information required and collected to manage & execute our Services
“Customer,” “you,” or “your” means the individual or legal entity that uses the Services.
“Subscription” means a customer's agreement to pay a single, fixed fee once a year for our Services.
“Content” means any text, graphics, images, logos, data, and other materials provided via the Services.
“Equipment” means flags, poles, sleeves, or other hardware used in the Service offering
2. Eligibility
· You must be at least 18 years old to submit a subscription request and obtain services
· You agree not to use the Equipment or Services for any unlawful or prohibited purpose and to comply with all applicable laws
3. Changes to the Terms
· We may modify these Terms and Conditions from time to time. We will provide notice of material changes and, where required, obtain your consent. Your continued use after the change constitutes acceptance of the updated Terms and Conditions.
· If you do not agree to the updated Terms and Conditions, you may cancel your subscription in accordance with our cancellation process.
4. Access and Use of the Services
Subscription: We grant you a limited, non-exclusive, non-transferable, revocable subscription to use the Services for your internal business and personal purposes, subject to these Terms and Conditions.
Restrictions: You shall not (a) copy, modify, or create derivative works of the Services, (b) sell, resell, lease, or sublicense the Services, (c) use the Services in a manner that could damage, disable, overburden, or impair them.
5. Subscriptions and Payments
Pricing: Subscriptions are offered at the prices stated on our site at the time of purchase. Prices may change with notice and will apply to auto-renewed annual subscriptions.
Billing: Subscriptions are billed in advance for the applicable period (annually for Subscriptions, per occurrence for events & rentals).
Payment methods: Various payments methods will be offered through third-party payment processor and include, but not limited to, credit card and ACH.
Trials and Promotions: Any free trial or promotional offers are subject to their own terms and may require a payment method for automatic continuation.
Renewal: Subscriptions auto-renew each year in January unless you cancel in accordance with our cancellation policy.
Refunds: If any, are governed by our subscription cancellation terms which may be updated from time to time.
Late payment: We may suspend or terminate access for non-payment after reasonable notice.
6. Cancellations and Termination
· You may cancel your subscription in accordance with our Cancellation Notice (see below). Cancellations take effect immediately.
· We may suspend or terminate access for violations of these Terms, misuse of the Services, or non-payment, with notice where feasible.
· Upon termination, your right to access the Services ends, and certain data may be retained or deleted in accordance with our Privacy Policy and data retention practices
· Upon cancellation by a customer, our Services will be suspended immediately and your account will be deactivated at the end of the current billing cycle
7. Intellectual Property
Ownership: All Content and Equipment provided through the Services are owned by Backyard Remedy, LLC. You retain no ownership rights of Content or Equipment by using the Services.
Trademarks: All logos and marks are the property of their respective owners.
8. Data Privacy and Security
Privacy: Your use of the Services is also governed by our Privacy Policy found on our website Flags-for-Freedom.com. You consent to the collection, storage, and use of data as described therein.
Security: We implement reasonable security measures but cannot guarantee absolute security. You acknowledge inherent risks in data transmission and storage.
9. Disclaimers
· The Services are provided “as is” and “as available.” We make no warranties regarding uptime, accuracy, reliability, or fitness for a particular purpose. We cannot guarantee uninterrupted or error-free operation due to circumstances beyond our control.
10. Limitation of Liability
· To the maximum extent permitted by law, our total liability arising out of or related to these Terms and Conditions or the Services is limited to the amount you paid for the applicable subscription in the 12 months preceding the claim.
· We are not liable for indirect, incidental, special, or consequential damages, including property damage, and theft.
· Backyard Remedy, LLC commits to maintaining a commercial umbrella insurance policy provides an additional layer of liability protection
11. Indemnification
· You agree to defend, indemnify, and hold harmless Backyard Remedy, LLC, its affiliates, officers, and employees from any claims, damages, damages, losses, and expenses arising from your use of the Services, violation of these Terms, or infringement of third-party rights.
12. Third-Party Services
· The Services may integrate with or rely on third-party services such as payment processing. We do not control these third parties and are not responsible for their products or services. Your use of third-party services is subject to their terms.
13. Governing Law and Dispute Resolution
· These Terms are governed by the laws of the state of Illinois.
14. International Use
· Our Services are only available to residents of the United States, more specifically, customers residing in the zip codes maintained on our website Flags-for-Freedom.com
· You are responsible for compliance with applicable local, State and Federal laws.
15. Payments and Taxes
· We may charge taxes as required by law
16. Service Availability and Support
· We will use reasonable efforts to provide the Services, but we cannot guarantee 100% uptime due to circumstances beyond our control

17. Modifications to the Services
· We may modify, suspend, or discontinue the Services or features with or without notice. We endeavor to provide alternative solutions where feasible
18. Severability
· If any provision is unenforceable, the remaining provisions remain in effect with the invalid provision reformed to reflect the parties’ intention.

· These Terms and Conditions, together with our Privacy Policy, Cancellation Notice, and any other policies referenced, constitute the entire agreement between you and us regarding the Services.

Subscription Cancellation Notice
1. How to Cancel
· You can cancel your subscription anytime from going to the Flags-for-freedom.com website by submitting a cancel subscription request
· Cancellations take effect immediately and Services will be suspended
2. When Cancellation Takes Effect
· If you cancel before your next billing date, the renewal will be canceled and your subscription will not be auto-renewed for the next period
· If you cancel on or after your renewal date, you may be charged for the current period
3. Refunds
Refund eligibility depends on the plan, timing, and our refund policy:
· Backyard Remedy, LLC provides direct financial support to two non-profit organizations that benefit military personnel injured or killed while serving our country
· Therefore, Service cancellations do not automatically qualify for a refund of the current billing period. However, customers cancelling due to special circumstances beyond their control could be eligible for a refund of the current billing period
4. Automatic Renewals and Dues
· All Subscriptions plans will auto-renew each year in January; you will be charged according to the plan’s renewal terms until you cancel.
· You will receive a confirmation email after cancellation
